These terms and conditions apply to all guests of B&B Het Blije Schaap, located at Zeedijk 6, 9171 AM Blije.

Definitions

  1. Customer: a person, organization, or company that books a stay at B&B Het Blije Schaap or books for a third party.
  2. Guest: a person equal to the customer and/or the person staying at B&B Het Blije Schaap based on the customer’s reservation.
  3. Owner: the owner of B&B Het Blije Schaap or the person acting as manager on behalf of the owner.
  4. Booking: a reservation request confirmed in writing by B&B Het Blije Schaap.
  5. Cancellation: The revocation or termination of the final booking within the applicable period or a no-show at the time of booking.
  6. Third parties: any other person and/or legal entity that is not a guest, manager or owner.
  7. Stay: The entire period from the moment of check-in/arrival to check-out/departure.
  8. B&B: the spaces for overnight stays and accommodation of B&B Het Blije Schaap.
  9. Accommodation: the space booked at B&B Het Blije Schaap.
  10. The website: this refers to the website https://www.hetblijeschaap.com

1 General

  • These terms and conditions automatically come into effect when entering into an agreement with B&B Het Blije Schaap.
  • Deviating conditions and/or stipulations, including the customer’s general terms and conditions, do not form part of an agreement, unless these conditions or stipulations have been accepted in writing by B&B Het Blije Schaap.
  • B&B Het Blije Schaap is described on the website www.hetblijeschaap.com. The website has been created with care, but differences may arise between the texts and photos on the website and the actual situation. Guests cannot derive any rights from this.
  • Guest pets are not allowed.
  • Smoking is not allowed anywhere in the B&B. This is allowed outside, but the guest is responsible for ensuring that cigarette butts, when sufficiently extinguished, are disposed of in the designated ashtrays or trash cans.
  • Cars can be parked in the designated parking spaces of B&B Het Blije Schaap. Parking is at your own risk.
  • Guests must always follow the instructions of the owner.
  • The owner can deny guests access to the location of B&B Het Blije Schaap immediately in the event of violation of the general terms and conditions and/or the house rules, or in the event of inappropriate behavior, without further notice and statement of reasons, and without refund of accommodation costs.
  • Customers must be 18 years or older to make a reservation.
  • Customers and guests must have a permanent place of residence.

2 Booking and confirmation

  • An option can be placed on an accommodation by the customer. This option remains valid for 24 hours and can be extended in consultation.
  • If there are other interested parties during the option period, B&B Het Blije Schaap will contact you immediately after the option period to ask whether the customer wants to convert the option into a booking.
  • An option can always be canceled free of charge.
  • Bookings can be made verbally, by telephone, via email or via the website.
  • A booking only becomes final for the guest and the owner when it has been confirmed by the owner by email.

3 Prices

  • All prices of B&B Het Blije Schaap can be found on the website. These prices include VAT.
  • Prices per night of B&B Het Blije Schaap include breakfast and tourist tax.
  • All prices are non-binding and subject to interim changes.
  • All statements on the website are deemed to have been provided in good faith and are always subject to interim adjustments. B&B Het Blije Schaap is not bound by obvious errors on the website.
  • All prices exclude the costs of cancellation and/or travel insurance (guests must take care of such insurance themselves) and/or other costs.

4 Invoicing and payment

  • Payment of 50% of the total reservation amount must be made no later than 1 month before the check-in date. If the check-in date is within 1 month of booking, payment of 50% of the total reservation amount must be made immediately upon booking.
  • The total reservation amount must be paid no later than 24 hours before the check-in date.
  • For reservations from abroad, the total reservation amount must be paid no later than 21 days before the check-in date. If the check-in date is within 21 days of booking, full payment must be made immediately upon booking.
  • Consumptions from the minibar, rental of electric bicycles, etc. are not included and payment for this must be made in the B&B before check-out.
  • Payment can be made via iDeal, bank transfer, with PIN or cash (exact amount).
  • For an ‘early bird holiday’ for the high season/school holidays, you will be asked to pay 50% of the total reservation amount immediately after booking. The total reservation amount must be paid 1 month before the check-in date. This also applies to bookings from abroad.

5 Cancellation

  • In the event of cancellation, the customer will pay compensation to the owner:
    •  in the event of cancellation within 1 month before the check-in date, 25% of the entire reservation amount;
    •  in the event of cancellation within 2 weeks before the check-in date, 50% of the entire reservation amount;
    •  in the event of cancellation within 1 week before the check-in date, 75% of the entire reservation amount;
    •  in the event of cancellation on the day of the check-in date or during your stay, 100% of the entire reservation amount.
  • The amount due in the event of cancellation must be transferred to the owner’s bank account number within 7 days.
  • If you are unexpectedly unable to fulfill the booking made, you must notify us as soon as possible so that we can still offer the reservation that has become available to third parties.
  • No refund will be given for later arrival or earlier departure.
  • Cancellations can be communicated verbally, by telephone, by email (contact@hetblijeschaap.com) or via the contact form on the website.
  • B&B Het Blije Schaap has the right to withdraw a final reservation in the event of unforeseen serious personal circumstances or calamities. Amounts already paid will then be fully refunded to the customer.
  • If you want to move the booked stay to a later period for any reason, the original cancellation period will remain in effect in relation to the first booking.
  • If you move your holiday to the high season, the higher amount will be charged.

6 Your stay

  • You are requested to report to the owner upon arrival.
  • You can check in between 3:00 PM and 9:00 PM and check out between 7:00 AM and 11:00 AM. If you want to check in earlier or check out later, this is only possible in consultation.
  • The B&B space is furnished for four guests. It is possible, in consultation, to place an extra baby or cot.
  • Noise pollution, especially between 10:00 PM and 7:00 AM, must be prevented.
  • Radios, televisions and other sound sources must not cause nuisance to others.
  • Use of the accommodations by third parties is not permitted.
  • You are free to use books, magazines and games in the accommodation. We trust that you will put them back neatly and completely. You may take folders and maps of the area with you, unless otherwise indicated by a sticker ‘for inspection’.
  • Visitors may not stay overnight in the accommodation without the permission of the manager and without additional payment.
  • Breakfast is served in the dining room. Or outside in good weather if the guest wishes.
  • Allergies or other dietary requirements regarding breakfast must be stated when making your reservation.
  • The guest must behave properly and use the accommodation in accordance with the reasonable instructions for use given by the owner.
  • The customer named in the booking confirmation is responsible for the orderly course of events in and around the relevant accommodation.

7 Safety and environment

  • Vehicles must be parked in the designated parking spaces.
  • The accommodation must be kept clean and tidy and left as such.
  • Waste must be separated and deposited in the designated trash can.
  • A first aid kit is available from the owner.
  • Approved fire extinguishers are present and will be designated by the owner upon your arrival.
  • The presence of suspicious persons must be reported to the owner immediately.
  • Pets are not allowed.
  • Smoking, candles and open fires are not permitted in the building due to fire safety.
  • A fine of €250.00 applies to misuse of fire/extinguishing equipment or disabling the smoke detector.
  • The accommodation is accessible 24 hours a day during your stay.
  • Other facilities on and around the yard must be used with care and in accordance with their intended purpose by the guests. This includes: furniture, surrounding roads, cycle paths, fences, etc.
  • The safety of any child or otherwise person in need of assistance must be guaranteed by the parents or guardians.
  • It is not permitted to feed our pets without consultation or take them to the B&B area (no matter how sweetly they look at you).

8 Damage

  • If the keys are forgotten to be handed in upon check-out, the customer is obliged to send the keys to the B&B owner by registered mail within 2 working days.
  • In the event of loss or otherwise non-return of keys to the accommodation, all resulting costs will be charged to the customer (this includes replacing the locks). The customer undertakes to pay the invoice within 14 days of sending it.
  • The customer is legally liable for damage caused by him or his fellow guests to the accommodation or the items present therein.
  • An incident of damage (damage, loss, loss and/or theft) must be reported by the guest to the owner immediately. Repair and/or replacement costs must be reimbursed by the guest to the owner at his first request.
  • If it turns out after departure that items have been left broken and this has not been reported to the owner, the invoice for the repair and/or replacement costs incurred will still follow.
  • The owner is not liable for damage, loss or theft of property of the guests.
  • In the event of disputes, all (legal) costs are for the account of the customer.
  • All risks relating to a stay at B&B Het Blije Schaap are for the account of the customer and/or guests.

9 Complaints
The guest may always submit a complaint. B&B Het Blije Schaap will always handle a complaint adequately and with due speed, in such a way that the complaint is handled according to standards of reasonableness and fairness.

10 Force majeure

  • In the event of force majeure, both of a permanent and temporary nature, B&B Het Blije Schaap is entitled to dissolve the agreement in whole or in part or to suspend it temporarily without the guest being able to claim compliance with compensation. Force majeure includes, but is not limited to: war (danger of war), disruptions in the energy circuit, government measures, natural disasters and all extraordinary (weather) conditions, the death of one of the owners or a close family member, as a result of which full or partial compliance with the agreement cannot reasonably and fairly be required of the owner.
  • In one of these cases, the owner will send the guest an alternative offer as soon as possible.
  • If this is not possible or the customer does not accept the alternative offered, the full amount already paid will be refunded.
  • Any other damage as a result of the cancellation will not be compensated by the owner.

11 liability

  • B&B Het Blije Schaap cannot be held liable by the customer, guest or third parties for damage suffered as a result of the stay in the accommodation; the customer and guest indemnify the owner against claims in this regard.
  • B&B Het Blije Schaap is not liable for disruptions in and around the accommodation, such as disruptions and failures of electricity and water supplies and technical installations, and construction and/or road works in the vicinity of the location that are not or not timely announced.
  • The owner can only be held liable for damage that is due to the gross negligence or negligence of the owner.
  • Without prejudice to the provisions above, the liability of the owner, if and insofar as B&B Het Blije Schaap, for any reason whatsoever, is held liable in law with regard to the user agreement, is limited to direct damage and any form of consequential damage is excluded.
  • The liability of the owner is also always limited to the maximum amount that the insurer of B&B Het Blije Schaap will pay out in the event in question.
  • B&B Het Blije Schaap accepts no liability for injury to persons and/or damage, loss or theft of property of the customer, guest or third parties.

13 Final provision

  • Insofar as not otherwise stipulated in rules of international private law, only Dutch law applies to the present terms and conditions. Non􏰀 Dutch-speaking guests are deemed to agree to the general terms and conditions drawn up in Dutch.
  • All disputes arising from the user agreement or these terms and conditions will be settled in the first instance by the competent court in the Netherlands, insofar as the rules of international private law do not stipulate otherwise.
  • Neither party may transfer its rights and obligations to third parties insofar as nothing else is stipulated in the present terms and conditions.
  • If and insofar as any provision in the user agreement and the present terms and conditions should prove to be void, the other terms and conditions will remain in force and the void article will be deemed to have been converted in such a way that it is brought into accordance with the apparent intentions of the parties.
